"SUPER ALLOWANCE" SWEEPSTAKES
OFFICIAL RULES
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE'S CHANCES OF WINNING
I. SPONSOR:
Radio Disney, a division of ABC Radio Networks Assets, LLC, P.O. Box 802626, Dallas, TX 75380, whose decisions are final and binding as to all aspects of this sweepstakes ("Sweepstakes").
II. ELIGIBILITY
The Sweepstakes is open to anyone 14 years of age or younger who is a legal resident of, and physically located within, the 50 United States or D.C. ("Territory").
Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for Sponsor, Radio Disney Group, LLC, any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies; (individually and collectively, "Entities"), members of their households and immediate families and any person who, within the past six months, has been awarded a Grand Prize in any sweepstakes conducted by Sponsor, are not eligible to enter or play. "Members of households " shall mean people who share the same residence at least three months a year. "Members of immediate families" shall mean parents, step-parents, children, step-children, siblings, step-siblings and spouses.
III. HOW AND WHEN TO ENTER
On-line Entry: During the period commencing at 3:00:00 A.M., August 18, 2007, and ending at 3:00:00 P.M., September 4, 2007 ("Term"), the Sweepstakes may only be entered On-line by a registered Disney.com guest ("Member"). For purposes of these Official Rules ("Rules"), all times are Pacific Daylight Time and "Day" shall mean the period commencing at 3:00:00 A.M. of one day and ending at 2:59:59 A.M. of the next day, except that the last Day shall be 3:00:00 A.M. to 3:00:00 P.M., September 4, 2007. If you are not already a Member, you may easily register to become a Member for free through the link on the site: "Register" by filling out the simple Registration Form. The Code Word of the Day ("Word") will be announced on Radio Disney at various times throughout each Day. A Member may enter by going directly to www.RadioDisney.com ("Website"), clicking on the "Listen for a Chance to Win" Quick Link, entering the Word and clicking on the "enter" button. If you have entered the correct Word, you will be asked to Log In with the Member Name and Password that was set up when you registered. Once you have logged in, a Word submission of the correct Word will result in one (1) On-line Entry to be entered into the Sweepstakes to win the Grand Prize. Your parent/legal guardian ("Parent") will be sent an initial e-mail notification advising Parent that his/her child has registered at RadioDisney.com for entry into a Radio Disney Sweepstakes, asking Parent to verify this entry by clicking on a link in the e-mail, validating child's entry as described in the e-mail and providing the phone number where the Parent can be reached if his/her child is chosen as a potential winner. After the validation process, the child will automatically be able to enter subsequent Radio Disney Sweepstakes by entering the correct Word and logging in up to once every day during a particular Sweepstakes period. If the Parent doesn't validate the child's registration and On-line Entry, the Entry will be denied. Normal internet access and usage charges imposed by your online service will apply. It is your sole responsibility to notify Sponsor if you or your Parent change e-mail address ("Address"). To do so, go to http://register.go.com/disney/GuestServices/YourAccount/login, log into your Membership Account, click on the "Modify" icon and follow the instructions on how to change the Address.
On-air Entry: During the Term, pursuant to official contest rules ("Radio Rules"), Radio Disney will periodically conduct games of skill ("Contests") in which the winning contestants ("Contest Winners") are chosen via games that the on-air talent plays with listeners that call in. A contestant must accomplish the following elements to become a Contest Winner: [1] call in on the 888-327-7018 toll free line ("Phone"); [2] elicit an answer on the Phone; [3] receive an invitation to participate in a Contest on the Phone and [4] win a Contest prize. All Contest prizes and Winners will be announced on-air. Each Contest Winner, excluding contestants between the hours of 9:00:00 A.M. and 11:00:00 A.M., Monday-Friday, will automatically be entered in the Sweepstakes resulting in one-hundred (100) On-air Entries in the Sweepstakes. Only calls to the Phone can win. From time to time, Radio Disney will broadcast summaries of the Radio Rules and announce that copies of the Radio Rules are available by writing to: Radio Disney Rules, at Radio Disney, P.O. Box 802626, Dallas, TX 75380, or via the Website.
"Entry" shall mean and refer to each On-line and On-air Entry.
During the Term, all Radio Disney and Radio Disney affiliated stations will promote, by means of on-air commercial spots, the opportunity to win the Grand Prize described below. New radio stations may be added at any time during the Term, as they become participating Radio Disney affiliates.
All Entries must be received or credited by 3:00:00 P.M., September 4, 2007. Regardless of method of Entry and whether one person has more than one Address or more than one person use the same Address, only one (1) On-line Entry per person/Address per Day is permitted (a maximum of eighteen (18) per entrant during the Term) and only one-hundred (100) On-air Entries per person per Day is permitted (a maximum of eighteen hundred (1,800) per entrant during the Term). However, only one method of Entry is permitted each Day.
Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, "Releasees") are responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are altered, defective, delayed, deleted, destroyed, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, invalid, late, lost, misrouted, non-delivered, stolen, tampered with, unauthorized or unintelligible; or any printing, production, technical, electronic or other errors; or for the inability of Phone caller to complete call within specified time, whether due to busy line, disconnections, telephone malfunctions or other circumstances, or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable e-mails resulting from any form of active or passive e-mail filtering; insufficient space in entrant's e-mail account to receive e-mail; or other errors of any kind, whether due to electronic, mechanical or human error or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations. In event of a dispute regarding the identity of the person submitting an On-line Entry, the Entry will be deemed to be submitted by the person in whose name the Address is registered.
IV. PRIZE
ONE (1) GRAND PRIZE: If you are the winner ("Winner"), Radio Disney will be giving you a Super Allowance paid out over an entire year; and it's all going to add up to a grand total of FIVE THOUSAND DOLLARS (approximate retail value: $5,000). There are no other prizes. The prize will be awarded provided it is validly claimed by October 5, 2007, after which no alternate Winner will be selected; nor unclaimed prize awarded.
Federal, state and local taxes are the sole responsibility of the Winner, whose Parent will receive an IRS Form 1099 reflecting the value of the prize.
Winner is not entitled to exchange or transfer the prize or to obtain other substitutes, but Sponsor in its sole discretion may substitute a prize of equal or greater value.
Sponsor is not responsible for circumstances that make it impractical or impossible to fulfill all elements of the prize, and Sponsor's only obligation will be to provide the remaining elements, if any, of the prize.
V. HOW AND WHEN A WINNER WILL BE SELECTED AND NOTIFIED
On or about September 5, 2007, a potential Winner will be selected at random from all eligible Entries received. Odds of winning depend on the total number of eligible Entries received. Many will enter; only one (1) will win.
The potential Winner will be notified by e-mail on or about September 5, 2007. Winner must meet all eligibility requirements. All legal responsibilities of a minor under the Rules will be assumed by a Parent. Disqualification, forfeiture of the prize and the selection by random drawing of an alternate Winner, time permitting, may result from any of the following: [1] potential Winner's failure to respond to e-mail notification within five (5) days from the date of receipt; [2] the return of potential Winner's e-mail notification as undeliverable after three (3) attempts; [3] the return of any other notification as undeliverable; [4] potential Winner's failure to provide satisfactory proof to Sponsor of his/her age, identity and residency; [5] potential Winner's failure to execute and return an Affidavit of eligibility/compliance with Rules, publicity/liability release and indemnification within seven (7) days from the date of mailing; [6] potential winners failure to validly claim the prize by October 5, 2007 and [7] any other non-compliance with Rules.
VI. CONDITIONS AND RELEASES
Each entrant by entering this Sweepstakes agrees that: [1] he/she will abide by and be bound by the Rules and the Sponsor's decisions; [2] the Entry becomes solely the Sponsor's property and will not be acknowledged; [3] he/she releases and holds harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the prize; participation in this Sweepstakes or in any activity or from any interaction with, or downloading of, computer Sweepstakes information; [4] Winner's acceptance of the prize constitutes the grant of an unconditional right to Sponsor and assigns to use Winner's name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [5] in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor's reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of this Sweepstakes, so that it cannot be conducted as originally planned, the Sponsor has the right to cancel, modify, terminate or suspend the Sweepstakes; and in such event, to select a Winner by random drawing from among all eligible Entries received up to such time of cancellation, modification, termination or suspension; [6] the Releasees are not responsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to: errors in the advertising, Rules and selection and announcement of the Winner; [7] Sponsor may, in its sole discretion, disqualify any individual who tampers with the entry process; [8] any portion of the prize not accepted or used by the Winner will be forfeited and [9] the Releasees are not responsible for the inability of the Winner to accept or use the prize (or any portion thereof) for any reason
