OPERATION "FUNATOMY" PARTS SWEEPSTAKES
OFFICIAL RULES
I. NAME OF SPONSOR
Radio Disney, a division of ABC Radio Networks Assets, LLC (hereinafter referred to as "Sponsor"), P.O. Box 802626, Dallas, TX 75380, whose decisions are final and binding as to all aspects of this sweepstakes ("Sweepstakes").
II. ELIGIBILITY
The Sweepstakes is open to anyone who is a legal resident of, and physically located within, the 50 United States or D.C. ("Territory"). Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for Sponsor, Radio Disney Group, LLC, Hasbro, any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies; (individually and collectively, "Entities"), members of their households and immediate families and any person who, within the past six months, has been awarded a Grand Prize in any sweepstakes conducted by Sponsor, are not eligible to enter or play. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year.
III. HOW AND WHEN TO ENTER
On-line Entry: Between 12:00:01 A.M., September 15, 2008 and 11:59:59 P.M., October 24, 2008 ("Term"), the Sweepstakes may only be entered On-line by a registered Disney.com guest ("Member"). For purposes of these Official Rules ("Rules"), all times are Pacific Daylight Time and "Day" shall mean a calendar day during the Term. A registered Member may enter by going directly to www.radiodisney.com ("Website"), clicking on the "Win Big" Quick Link, then clicking on the Operation "Funatomy" Sweepstakes icon or you may go directly to http://radio.disney.go.com/win/funatomyparts/index.html and click the "Enter Now" button. You will be asked to Log In with the Member Name and Password that was set up when you registered and click on the "Submit" button which will result in one (1) Entry to be entered into the Sweepstakes to win a Grand Prize. If you are not already a Member, you may register to become a Member for free through the link on the site: Register by filling out the Registration Form. Upon becoming a Member by registration, you may enter the Sweepstakes by following the above instructions. Parent/legal guardian ("Parent") of a child under the age of 13 will be sent an email notifying him/her of the child's Entry into the Sweepstakes. No response by the Parent to the email is required for the child to enter; however, if the Parent does not want his/her child to enter, Parent may click on a link in the email and complete the steps required to cancel the child's Entry and delete the child's information. Normal internet access and usage charges imposed by your online service will apply. It is your sole responsibility to notify Sponsor if you or your Parent change Address. To do so, go to http://register.go.com/disney/GuestServices/YourAccount/login, log into your Membership Account, click on the "Modify" icon and follow the instructions on how to change the Address.
All entries for the Sweepstakes must be received during the Term within any of the following Weekly Sweepstakes Periods ("Weekly Period"), commencing at 12:00:01 A.M. and ending at 11:59:59 P.M. of each Weekly Period:
Week 1 - September 15, through September 21, 2008
Week 2 - September 22, through September 28, 2008
Week 3 - September 29, through October 5, 2008
Week 4 - October 6, through October 12, 2008
Week 5 - October 13, through October 19, 2008
Week 6 - October 20, through October 24, 2008
During the Term, all Radio Disney and Radio Disney affiliated stations will promote, by means of on-air commercial spots, the opportunity to win one of the Weekly Prizes as described below. New radio stations may be added at any time during the Term, as they become participating Radio Disney affiliates. All Entries must be received by 11:59:59 P.M. on the last day of each Weekly Period. Regardless of whether one person has more than one Address or more than one person use the same Address, only one (1) Entry per person/Address per Day is permitted (a maximum of forty (40) per entrant during the Term). Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, "Releasees") are responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are altered, delayed, deleted, destroyed, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, late, lost, misrouted, non-delivered, stolen, tampered with, unauthorized or unintelligible; or any printing, production, technical, electronic or other errors; or for technical failures of any kind, including but not limited to: electronic malfunction or damage of any network, hardware or software; lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable e-mails resulting from any form of active or passive e-mail filtering; insufficient space in entrant's e-mail account to receive e-mail; or other errors of any kind, whether due to electronic, mechanical or human error or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations. In the event of a dispute regarding the identity of the person submitting an Entry, it will be deemed to be submitted by the person in whose name the Address is registered.
IV. HOW AND WHEN A WINNER WILL BE SELECTED AND NOTIFIED
On or about October 28, 2008, forty-two (42) Grand Prize Winners ("Winners") will be selected from all eligible Entries received during the Term, which will include seven (7) Winners from each of the six (6) Weekly Periods selected at random.
Winners must meet all eligibility requirements. In the event Winners are deemed ineligible, or are not available to claim prize during specified dates, then an alternate winner will be selected at random from eligible entries received, time permitting.
The Winners will be notified by phone and e-mail on or about October 28, 2008; and will receive an Affidavit of eligibility/compliance with Rules, publicity/liability release and indemnification via mail within five (5) days of notification. All legal responsibilities of a minor under the Rules will be assumed by a Parent. Winner will be required to provide satisfactory proof to Sponsor of his/her age, identity and residency. Response to mail notification must be received by Sponsor within seven (7) business days or the prize will be forfeited and may be awarded to an alternate winner, time permitting.
Odds of winning depend on the total number of eligible Sweepstakes Entries received during each Weekly Period throughout the Term. Many will enter; only forty-two (42) will win.
V. PRIZE(S)
FORTY-TWO (42) GRAND PRIZES: A winner of the Sweepstakes ("Winner") will receive a Hasbro Games Pack ("Games Pack"), including six (6) games. Grand Prizes consist of one (1) Games Pack per Winner, including the following games: [1] Operation; [2] Twister; [3] Guess Who; [4] Perfection; [5] Hannah Montana Mall Madness; and [6] Cosmic Keep Away. There are no other prizes. Approximate retail value ("ARV") of Games Pack is $ 109. ARV of all prizes is $4,578. Grand Prizes will be awarded provided they are validly claimed by November 28, 2008, after which alternate Winners may be selected, time permitting.
All expenses not specifically provided for herein are the winner's sole responsibility. Some restrictions may apply.
Winners are not entitled to exchange or transfer prizes or to obtain cash or other substitutes, but Sponsor in its sole discretion may substitute prizes of equal or greater value.
If won by a minor, prize will be awarded in parent's or guardian's name.
Prizes are subject to availability. Sponsor is not responsible for any circumstances that make it impractical or impossible to fulfill all elements; Sponsor's only obligation will be to provide the remaining elements, if any, of the prize.
VI. RELEASES
By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor and the Sweepstakes administrator, which shall be final in all respects.
By participating in this Sweepstakes and/or accepting any prize that they may win, entrants agree to release Radio Disney, a division of ABC Radio Networks Assets, LLC, Hasbro, their parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of the prize.
Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, in any media now known or hereafter created or conceived, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor's sole discretion, without further obligation or compensation.
To claim prize, winner and/or winner's parent or guardian must: (a) provide proof of winner's age, residency, and legal status; and (b) sign and return eligibility, publicity, liability and any other releases requested by Sponsor within the time period(s) specified by Sponsor.
VII. MISCELLANEOUS; WINNERS' LIST
Void where prohibited. All federal, state and local laws and regulations apply.
Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the contest in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the contest as originally planned.
For a list of winners, send a self-addressed, stamped #10 envelope to: Operation "Funatomy" Parts Sweepstakes, c/o Radio Disney, P.O. Box 802626, Dallas, Texas 75380. Vermont residents may omit return postage.
