RADIO DISNEY "MIGHTY U" CONTESTS
OFFICIAL RULES
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE'S CHANCES OF WINNING
1. SPONSOR: Radio Disney, a division of ABC Radio Networks Assets, Inc., P.O. Box 802626, Dallas, TX 75380, whose decisions are final and binding as to all aspects of each of these monthly contests ("Monthly Contest").
2. ENTRY: During each of the twelve (12) calendar months of January through December, 2007, Sponsor will conduct a Monthly Contest to recognize a child of 14 or younger ("Child") for having achieved a "significant" goal in the last twelve months by selecting him/her as Radio Disney's Mighty U for that month. For purposes of these Official Rules ("Rules"), all times and months are Central Time. Anyone may nominate a Child for a Monthly Contest by entering him/her as a Contestant; and a Child may even nominate himself or herself. The person entering the Contestant ("Nominator") may only do so online as a registered Disney.com guest ("Member"). If you are not already a Member, you may easily register to become a Member for free through the link on the site: "Not Registered?" by filling out the simple Registration Form. If you are a Child, your parent/legal guardian ("Parent") will be sent an e-mail advising Parent that his/her Child is attempting to participate in this Contest as a Contestant, asking Parent to verify this participation by clicking on a link in the e-mail, validating Child's participation as described in the e-mail and providing the phone number where the Parent can be reached. If the Parent doesn't validate the Child's participation, the participation will be denied. A Member may enter by going directly to www.RadioDisney.com ("Website"); clicking on the "Listen to Win" button; hitting the "Mighty U" button; entering the following: (1) Member's User Name and Password; (2) the full address, phone number and age of the Contestant; (3) a description of the goal achieved (in 50 words or less); (4) the full name, address and day and night phone numbers of the Nominator and (5) Nominator's relationship/connection to the Contestant; and clicking on the "submit" button ("Entry"). Normal Internet access and usage charges imposed by your online service will apply. It is your sole responsibility to notify Sponsor if you or your Parent change e-mail address ("Address"). To do so, go to http://register.go.com/disney/GuestServices/YourAccount/login, log into your Membership Account, click on the "Modify" icon and follow the instructions on how to change the Address.
3. LIMITATIONS: All Entries for a Monthly Contest must be received by 11:59:59 P.M. of the last day of that month. Only one Contestant per Monthly Contest per Nominator and only one goal per Contestant. Each Entry must be submitted separately by an individual Nominator. Entries must not infringe upon third party rights, nor previously have won awards, nor been published. Open only to Nominators and Contestants who are legal residents of, and physically located within, the 50 states or D. C. ("Territory") and who are not employees of Sponsor, its parent, subsidiary, affiliate or agency (individually and collectively, "Entities"); nor members of their households or immediate families. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, "Releasees") are responsible for Entries that are altered, defective, delayed, destroyed, fraudulent, inaccurate, incomplete, invalid, late, lost, misrouted, multiple, non-delivered, stolen, tampered with, unauthorized or unintelligible, or any printing, production, technical or other errors; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable e-mails resulting from any form of active or passive e-mail filtering; insufficient space in entrant's e-mail account to receive e-mail; or other errors of any kind, whether due to electronic, mechanical or human error or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.
4. PRIZES: TWELVE (12) GRAND PRIZES (one for each Monthly Contest): Prize package, consisting of the following elements: [1] a "Mighty U" certificate in the name of the winner [2] one (1) U.S. Savings Bond ("Bond") maturing in approximately 12-17 years for $1,000 (approximate retail value ["ARV"] currently: $500) and [3] one (1) set of ten (10) $10 iTunes gift cards for the winner to share with friends (ARV: $100). ARV of Grand Prize: $600. Total ARV of all prizes: $7,200. Only one winner per household for 2007. In the event that the Bond is redeemed prior to maturity, the value will be less than $1,000. Prizes are not redeemable for cash or transferable and no substitutions allowed except, at Sponsor's sole discretion, a prize of equal or greater value may be substituted. All prizes will be awarded provided a sufficient number of eligible entries are received and prizes validly claimed by thirty (30) days after the end of the applicable Monthly Contest, after which no alternate winner will be selected, nor unclaimed prize awarded.
5. PROCEDURES: Each Monthly Contest starts at 12:01 A.M. of the first day of the month and ends at 11:59:59 P.M. of the last day of the month. On or about the first day after each Monthly Contest, all eligible Entries for that Contest will be judged by Sponsor, who will select a winner who in the last 12 months has demonstrated the initiative and character to plan, undertake and achieve a significant and challenging goal. All non-winning Entries in a Monthly Contest will be ineligible for later Monthly Contests as they may not be carried over to a subsequent Contest. A new Entry must be submitted for each Monthly Contest; however, the same goal may be resubmitted for a subsequent Monthly Contest as long as it continues to meet the eligibility requirements.
6. WINNERS: Each potential winner for a Monthly Contest will be notified by U.S. Mail and announced on-air on or about the first Monday after that Monthly Contest. To qualify as a winner, the Contestant and his/her Nominator must meet all eligibility requirements and conditions set forth in the Rules. All legal responsibilities of a winner under the Rules will be assumed by his/her Parent. Disqualification and the selection of an alternate winner may result from any of the following: [1] potential winner's failure to respond to notification within ten (10) days after its mailing; [2] the return of any notice or prize as undeliverable; [3] potential winner's failure to provide Sponsor with certified birth certificate or other evidence of age satisfactory to Sponsor; [4] potential winner's failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release within ten (10) days after its mailing; [5] potential winner's failure to claim a prize within thirty (30) days after it is sent; [6] potential winner's failure to provide proof to Sponsor's satisfaction that he/she has actually achieved the goal; [7] potential winner's failure to provide his/her full name and social security number to the Sponsor; [8] potential winner's failure to sign and return any required documents in a timely manner and [9] any other non-compliance with Rules. The Bond will be mailed to each winner's residence within thirty (30) days after he/she has accepted the prize. All taxes are solely the responsibility of the winner. For list of 2007 winners (after January 15, 2008) and/or Rules (before December 31, 2007), send a self-addressed, stamped #10 envelope to: Radio Disney Mighty U Winners/Rules, P.O. 7. CONDITIONS: Each Nominator by participating in a Monthly Contest agrees that: [1] he/she will abide by and be bound by the Rules and Sponsor's decisions; [2] he/she irrevocably assigns and transfers to Sponsor and its assigns all rights in the Entry; [3] Entry will not be acknowledged or returned; [4] he/she grants to Sponsor and its assigns the right to publish, use, adapt, edit and/or modify the Entry in any way and in any and all media, without limitation, and without consideration to Nominator; [5] the Releasees are not responsible for claims, injuries or losses of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, redemption, use, misuse, possession, loss or misdirection of any prize; participation in any Monthly Contest or in any activity related thereto or from computer downloading any Monthly Contest information; [6] winner's acceptance of a prize constitutes the grant of an unconditional right to use winner's name, address (city and state only), likeness, prize information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [7] in the event unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor's reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of any Monthly Contest, so that it cannot be conducted as originally planned, the Sponsor has the right to cancel, terminate or suspend that Contest; and in such event, to select a winner from among all eligible Entries received up to such time of cancellation, termination or suspension; [8] the Releasees are not responsible for typographical or other errors in the offer or administration of any Monthly Contest, including but not limited to: errors in the advertising, Rules and selection and announcement of the winner; [9] any portion of any prize not accepted or used by any winner will be forfeited; [10] the Releasees are not responsible for any inability of any winner to accept or use any prize (or any portion thereof) for any reason and [11] Sponsor reserves the right to make such changes in the Rules as it deems desirable, to become effective upon announcement over the air and/or on Sponsor's website at www.disney.com.
